By booking a stay at one of our properties, you agree to comply with and be bound by the following Terms and Conditions. Staymist acts as a facilitator, connecting guests with property owners while ensuring a seamless booking experience. Do not continue to use Staymist’s website if you do not accept all of the terms and conditions stated on this page.
1. Definitions
Company, We, Our, or Us refers to Staymist.
You, Guest, or User refers to any individual using our services, website, or booking our properties.
Property refers to any accommodation listed under Staymist.
Facilitator refers to Staymist acting as an intermediary between property owners and guests, ensuring smooth booking and communication processes.
2. Disclaimer of Ownership
Staymist does not own or lease any of the properties listed. We act solely as a facilitator between guests and property owners. All accommodations are operated and maintained independently by their respective owners.
3. Booking Process
All bookings are subject to availability and confirmation.
Full payment or an advance is required to secure the booking.
Guests must provide valid government-issued ID proof before check-in.
Staymist reserves the right to cancel bookings due to unforeseen circumstances, with a full refund provided in such cases.
4. Security Deposit
A security deposit is mandatory for all stays and must be paid before check-in.
This deposit will be refunded upon check-out, subject to any deductions for damages or violations of the property’s rules.
5. Guest Responsibilities
Guests must respect the property, neighbors, and local regulations.
Any damage to the property, furniture, or fixtures will be charged to the guest.
Unregistered guests or parties without prior approval are prohibited.
Illegal substances, including drugs and unlawful alcohol consumption, are strictly prohibited.
Loud music and disturbances are not allowed beyond permitted hours as per local regulations.
6. Guest Conduct
Guests are expected to behave in a respectful and lawful manner. Any misconduct, including verbal or physical abuse toward staff, caretakers, or neighbors, may result in immediate termination of the stay without refund, and may be reported to authorities if required.
7. Liability, Indemnity & Limitation of Liability
Staymist and property owners are not responsible for lost or stolen items.
Guests are responsible for their own safety during their stay.
Staymist is not responsible for the operational condition, cleanliness, staffing, or maintenance of the properties. Guests acknowledge that all such responsibilities lie with the property owner. Any disputes or legal matters relating to conditions of the stay must be directed to the property owner.
By booking, guests agree to indemnify Staymist and property owners against any claims, damages, or losses arising from their stay.
To the fullest extent permitted by applicable law, Staymist’s liability to you shall not exceed the total amount paid by you for the booking.
8. Safety Disclaimer
Staymist curates listings based on information shared by property owners and facilitates guest support, but we do not inspect or guarantee the safety of the property environment, including but not limited to: pools, terraces, balconies, electricals, or other facilities.
Guests are advised to exercise caution and supervise minors or elderly guests at all times.
By booking, guests accept full responsibility for any risks associated with property usage and waive all claims against Staymist for injuries, accidents, or losses incurred during the stay.
Staymist and the respective property owner shall not be held responsible for any injury, medical emergency, or fatality that occurs during the guest’s stay, whether due to natural causes, accidents, personal health conditions, or any other unforeseen events. Guests acknowledge the inherent risks of staying at private properties and agree to assume full responsibility for their own safety and that of their accompanying guests.
9. Minors and Supervision
Minors must be under adult supervision at all times, especially near the pool and other potentially hazardous areas.
The property is not responsible for any accidents or injuries that occur due to lack of supervision.
10. Accuracy of Listings
While Staymist strives to ensure that property listings, descriptions, and photographs are accurate and updated, we are not liable for any discrepancies, changes in furnishings, aesthetics, or facilities that may occur at the time of stay. Guests are encouraged to reach out for clarifications before booking.
11. Content Usage
By staying at the property or submitting reviews, photos, or videos, guests grant Staymist a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, and publish such content across digital and print media for marketing and promotional purposes.
12. Third-Party Services
Any services provided by caretakers, cooks, drivers, or vendors arranged during the stay are independently offered and not directly operated by Staymist.
We are not liable for any issues, damages, or claims resulting from third-party services.
13. Insurance Disclaimer
Staymist does not provide travel insurance, personal accident insurance, or property insurance for guests. Guests are advised to obtain appropriate coverage at their own discretion.
14. Cancellations & Refunds
Our cancellation policy applies as per the terms outlined on our website.

No-shows or last-minute cancellations may not be eligible for a refund.
15. Emergencies
In case of emergencies, guests should contact local authorities immediately. Staymist may assist in coordinating responses but cannot guarantee emergency services.
16. Subletting Prohibited
Guests may not sublet or transfer their booking to any third party without prior written consent from Staymist.
17. Force Majeure
Staymist and property owners shall not be held liable for any failure or delay in performance of obligations under these terms if such failure or delay is due to circumstances beyond reasonable control, including but not limited to natural disasters, strikes, government restrictions, pandemics, war, or failure of telecommunications or internet services.
18. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Maharashtra, India. Any disputes arising shall fall under the exclusive jurisdiction of the courts located in Mumbai.
19. Amendments to Terms
Staymist reserves the right to modify these Terms & Conditions at any time. Continued use of our services implies acceptance of any updated terms.
20. Acknowledgement
By using our website, booking platform, or engaging our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
